حَدَّثَنِى إِسْحَاقُ بْنُ مَنْصُورٍ أَخْبَرَنَا عُبَيْدُ اللَّهِ بْنُ مُوسَى عَنْ شَيْبَانَ عَنْ يَحْيَى أَخْبَرَنِى أَبُو سَلَمَةَ أَنَّهُ سَمِعَ أَبَا هُرَيْرَةَ يَقُولُ إِنَّ خُزَاعَةَ قَتَلُوا رَجُلاً مِنْ بَنِى لَيْثٍ عَامَ فَتْحِ مَكَّةَ بِقَتِيلٍ مِنْهُمْ قَتَلُوهُ فَأُخْبِرَ بِذَلِكَ رَسُولُ اللَّهِ -صلى الله عليه وسلم- فَرَكِبَ رَاحِلَتَهُ فَخَطَبَ فَقَالَ « إِنَّ اللَّهَ عَزَّ وَجَلَّ حَبَسَ عَنْ مَكَّةَ الْفِيلَ وَسَلَّطَ عَلَيْهَا رَسُولَهُ وَالْمُؤْمِنِينَ أَلاَ وَإِنَّهَا لَمْ تَحِلَّ لأَحَدٍ قَبْلِى وَلَنْ تَحِلَّ لأَحَدٍ بَعْدِى أَلاَ وَإِنَّهَا أُحِلَّتْ لِى سَاعَةً مِنَ النَّهَارِ أَلاَ وَإِنَّهَا سَاعَتِى هَذِهِ حَرَامٌ لاَ يُخْبَطُ شَوْكُهَا وَلاَ يُعْضَدُ شَجَرُهَا وَلاَ يَلْتَقِطُ سَاقِطَتَهَا إِلاَّ مُنْشِدٌ وَمَنْ قُتِلَ لَهُ قَتِيلٌ فَهُوَ بِخَيْرِ النَّظَرَيْنِ إِمَّا أَنْ يُعْطَى - يَعْنِى الدِّيَةَ - وَإِمَّا أَنْ يُقَادَ أَهْلُ الْقَتِيلِ ». قَالَ فَجَاءَ رَجُلٌ مِنْ أَهْلِ الْيَمَنِ يُقَالُ لَهُ أَبُو شَاهٍ فَقَالَ اكْتُبْ لِى يَا رَسُولَ اللَّهِ. فَقَالَ « اكْتُبُوا لأَبِى شَاهٍ ». فَقَالَ رَجُلٌ مِنْ قُرَيْشٍ إِلاَّ الإِذْخِرَ فَإِنَّا نَجْعَلُهُ فِى بُيُوتِنَا وَقُبُورِنَا. فَقَالَ رَسُولُ اللَّهِ -صلى الله عليه وسلم- « إِلاَّ الإِذْخِرَ ».
Abu Hurairah said: “(The tribe of) Khuzaah killed a man from Banu Laith in the year when Makkah was conquered, in retaliation for one of their people whom they had killed. The Messenger Of Allah (SAW) was told about that, then he rode on his mount and addressed them saying: “Allah held the elephant back from Makkah, and He caused His Messengers and the believers to prevail over it. It was not permissible (to shed blood therein) for anyone before me and it is not permissible for anyone after me; It was only permitted to me for a part of a day. Now, at this very hour, it is sacred; Its trees are not to be cut down and its lost property is not to be picked up except by the one who announces it. Anyone whose (relative) has been killed has one of two choices: Either he may be given the Diyah or he may retaliate.” A man from Yemen, who was called Abu Shah, came to him and said: “Write it for me O Messenger Of Allah (SAW).”He said: “Write it for Abu Sahah.”A man of Quraish said: “Except Idhkhir, for we use it in our houses and in our graves.” The Messenger Of Allah(SAW) said:” Except Idhkhir.””
