حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ وَعَبْدُ بْنُ حُمَيْدٍ - وَاللَّفْظُ لِعَبْدٍ - قَالاَ أَخْبَرَنَا عَبْدُ الرَّزَّاقِ أَخْبَرَنَا مَعْمَرٌ عَنِ الزُّهْرِىِّ عَنْ عُبَيْدِ اللَّهِ بْنِ عُتْبَةَ أَنَّ أَبَا عَمْرِو بْنَ حَفْصِ بْنِ الْمُغِيرَةِ خَرَجَ مَعَ عَلِىِّ بْنِ أَبِى طَالِبٍ إِلَى الْيَمَنِ فَأَرْسَلَ إِلَى امْرَأَتِهِ فَاطِمَةَ بِنْتِ قَيْسٍ بِتَطْلِيقَةٍ كَانَتْ بَقِيَتْ مِنْ طَلاَقِهَا وَأَمَرَ لَهَا الْحَارِثَ بْنَ هِشَامٍ وَعَيَّاشَ بْنَ أَبِى رَبِيعَةَ بِنَفَقَةٍ فَقَالاَ لَهَا وَاللَّهِ مَا لَكِ نَفَقَةٌ إِلاَّ أَنْ تَكُونِى حَامِلاً. فَأَتَتِ النَّبِىَّ -صلى الله عليه وسلم- فَذَكَرَتْ لَهُ قَوْلَهُمَا. فَقَالَ « لاَ نَفَقَةَ لَكِ ». فَاسْتَأْذَنَتْهُ فِى الاِنْتِقَالِ فَأَذِنَ لَهَا. فَقَالَتْ أَيْنَ يَا رَسُولَ اللَّهِ فَقَالَ « إِلَى ابْنِ أُمِّ مَكْتُومٍ ». وَكَانَ أَعْمَى تَضَعُ ثِيَابَهَا عِنْدَهُ وَلاَ يَرَاهَا فَلَمَّا مَضَتْ عِدَّتُهَا أَنْكَحَهَا النَّبِىُّ -صلى الله عليه وسلم- أُسَامَةَ بْنَ زَيْدٍ فَأَرْسَلَ إِلَيْهَا مَرْوَانُ قَبِيصَةَ بْنَ ذُؤَيْبٍ يَسْأَلُهَا عَنِ الْحَدِيثِ فَحَدَّثَتْهُ بِهِ فَقَالَ مَرْوَانُ لَمْ نَسْمَعْ هَذَا الْحَدِيثَ إِلاَّ مِنِ امْرَأَةٍ سَنَأْخُذُ بِالْعِصْمَةِ الَّتِى وَجَدْنَا النَّاسَ عَلَيْهَا. فَقَالَتْ فَاطِمَةُ حِينَ بَلَغَهَا قَوْلُ مَرْوَانَ فَبَيْنِى وَبَيْنَكُمُ الْقُرْآنُ قَالَ اللَّهُ عَزَّ وَجَلَّ ( لاَ تُخْرِجُوهُنَّ مِنْ بُيُوتِهِنَّ) الآيَةَ قَالَتْ هَذَا لِمَنْ كَانَتْ لَهُ مُرَاجَعَةٌ فَأَىُّ أَمْرٍ يَحْدُثُ بَعْدَ الثَّلاَثِ فَكَيْفَ تَقُولُونَ لاَ نَفَقَةَ لَهَا إِذَا لَمْ تَكُنْ حَامِلاً فَعَلاَمَ تَحْبِسُونَهَا
It was narrated from 'Ubaidullah bin 'Abdullah bin 'Utbah that Abu 'Amr bin Hafs bin Al-Mughirah set out with 'Ali bin Abi Talib for Yemen, and he sent word to his wife Fatimah bint Qais with her final divorce, and told Al-Harith bin Hisham and 'Ayyash bin Abi Rabi'ah to give her some maintenance. They said to her: "By Allah, you will not have any maintenance unless you are pregnant." She came to the Prophet (s.a.w) and told him what they had said, and he said: "There is no maintenance for you." She asked him for permission to move, and he gave her permission. She said: "Where, O Messenger of Allah?" He said: "To Ibn Umm Maktum." He was blind, so she could take off her garments in his house and he would not see her. When her 'Iddah was over, the Prophet (s.a.w) married her to Usamah bin Zaid. Marwan sent Qabisah bin Dhuwaib to her to ask her about this Hadith, and she narrated it to him. Marwan said: "We have only heard this Hadith from a woman, so we will follow what we are certain of, which is what we found the people following." When news of what Marwan said reached Fatimah she said: "Between you and I is the Qur'an. Allah, Most High, says: "... And turn them not out of their (husband's) homes ...". She said: "This is for one whose divorce is revocable, so what new thing will Allah bring to pass after the third (irrevocable divorce)? How can you say that she is not entitled to maintenance if she is not pregnant? On what grounds do you detain her?"
"When a person dies, his works end, except for three: ongoing charity, knowledge that is benefited from, and a righteous child who prays for him."
