Sahih Muslim Book - 22, Hadith - 4129
وَحَدَّثَنِى أَبُو الطَّاهِرِ أَخْبَرَنَا ابْنُ وَهْبٍ عَنِ ابْنِ جُرَيْجٍ أَنَّ أَبَا الزُّبَيْرِ أَخْبَرَهُ أَنَّهُ سَمِعَ جَابِرَ بْنَ عَبْدِ اللَّهِ يَقُولُ قَالَ رَسُولُ اللَّهِ -صلى الله عليه وسلم- « الشُّفْعَةُ فِى كُلِّ شِرْكٍ فِى أَرْضٍ أَوْ رَبْعٍ أَوْ حَائِطٍ لاَ يَصْلُحُ أَنْ يَبِيعَ حَتَّى يَعْرِضَ عَلَى شَرِيكِهِ فَيَأْخُذَ أَوْ يَدَعَ فَإِنْ أَبَى فَشَرِيكُهُ أَحَقُّ بِهِ حَتَّى يُؤْذِنَهُ ».
Jabir bin 'Abdullah said: "The Messenger of Allah (s.a.w) said: 'There is preemption in every partnership in land, dwellings, or gardens. It is not right to sell until he offers it to his partner, who may take it or leave it. If he insists, then his partner has the greater right to it unless he notifies him."
