حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ الْحَنْظَلِىُّ أَخْبَرَنَا مَخْلَدُ بْنُ يَزِيدَ الْجَزَرِىُّ حَدَّثَنَا ابْنُ جُرَيْجٍ أَخْبَرَنِى عَطَاءٌ عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ أَنَّ رَسُولَ اللَّهِ -صلى الله عليه وسلم- نَهَى عَنِ الْمُخَابَرَةِ وَالْمُحَاقَلَةِ وَالْمُزَابَنَةِ وَعَنْ بَيْعِ الثَّمَرَةِ حَتَّى تُطْعِمَ وَلاَ تُبَاعُ إِلاَّ بِالدَّرَاهِمِ وَالدَّنَانِيرِ إِلاَّ الْعَرَايَا. قَالَ عَطَاءٌ فَسَّرَ لَنَا جَابِرٌ قَالَ أَمَّا الْمُخَابَرَةُ فَالأَرْضُ الْبَيْضَاءُ يَدْفَعُهَا الرَّجُلُ إِلَى الرَّجُلِ فَيُنْفِقُ فِيهَا ثُمَّ يَأْخُذُ مِنَ الثَّمَرِ. وَزَعَمَ أَنَّ الْمُزَابَنَةَ بَيْعُ الرُّطَبِ فِى النَّخْلِ بِالتَّمْرِ كَيْلاً. وَالْمُحَاقَلَةُ فِى الزَّرْعِ عَلَى نَحْوِ ذَلِكَ يَبِيعُ الزَّرْعَ الْقَائِمَ بِالْحَبِّ كَيْلاً.
It was narrated from Jabir bin 'Abdullah that the Messenger of Allah (s.a.w) forbade Mukhabarah, Muhaqalah and Muzabanah, and selling produce until it is fit to eat; it should not be sold except for Dirham and Dinar except in the case of 'Araya. ''Ata' said: "Jabir explained it to us and said: 'Mukhabarah refers to unused land which a man gives to another man who spends on it then (the owner) takes some of its produce in return. He said that Muzabanah means selling fresh dates on the tree for dried dates by measure, and Muhaqalah refers to something similar with regard to crops, where standing crops are sold for grains by measure."'
